[2010] EWCA Crim 1148

On the proper construction of the Enterprise Act 2002 s.188, concerning cartel offences and agreements to fix prices, to establish criminal liability the prosecution need only prove that the defendant had entered into an agreement dishonestly: there was no requirement for mutual dishonesty on the part of both the defendant and another individual.
