[2010] EWCA Crim 2243

A pre-trial ruling, that the two-person rule applicable in a case of outraging public decency had not been satisfied, had been reasonable. Although one witness had seen the defendant masturbating in a car, on the agreed evidence the defendant had stopped masturbating and had covered himself whenever other people had approached.
