[2004] EWCA Crim 1243

Evidence of recordings of the defendant talking on a mobile phone made by a surveillance device were admissible as it was not an interception for the purpose of the Regulation of Investigatory Powers Act 2000. The Act complied with Telecommunications Data Protection Directive 97/66EC and Art.8 European Convention on Human Rights and the Act went further than what was required by Art.8 and the Directive.
