An individual was not guilty of an offence under the Social Security Administration Act 1992 s.111A(1B) of dishonestly allowing the failure of his partner to give prompt notification of a change in her circumstances affecting her social security benefits, where there was no evidence of anything that the individual could have done that would have prevented his partner's failure to give notice, bearing in mind she knew of the change in circumstances and the obligation to give such notice was hers and not his.
