[2009] EWCA Crim 1452

A conviction for causing death by careless driving when under the influence contrary to the Road Traffic Act 1988 s.3A(1)(c) was safe as there was ample evidence that the offender had been driving without due care and attention and he had no reasonable explanation for his failure to provide a breath or blood sample.
