A conviction for possessing indecent photographs of children was quashed as the jury had not been directed to consider the potential significance of the fact that the images in most of the counts had been deleted, nor to the potential significance of that fact to the question of knowledge as a necessary ingredient of criminal possession of the material. As there were only a few images in non-deleted files, it was unlikely that the jury would have convicted the defendant on that evidence alone.
