[2012] EWCA Crim 3144

A community order was replaced with a conditional discharge following a guilty plea to possessing an extreme pornographic image. The sentencing judge had been sceptical of the offender's basis of plea, but had had no real basis for his scepticism, and the low level of culpability disclosed by the basis of plea did not justify a community order.
