A magistrates' court retained a jurisdiction to entertain a complaint of abuse of process on the grounds that the institution of criminal proceedings was frivolous or vexatious. However, in certain circumstances it was open to a magistrates' court to decline jurisdiction and require that the matter be pursued in the Divisional Court.
