R v B (2006)

PUBLISHED October 27, 2006

[2006] EWCA Crim 2692

In a criminal case that was likely to produce a lot of legitimate public debate, it was held to be unnecessary to postpone media reports until the conclusion of the trial of the co-defendants. An important safeguard against unfairness was the trust that should be placed in broadcasting authorities and newspaper editors to exercise sensible judgement about the publication of comment which might interfere with the administration of justice. A second important safeguard against the risk of prejudice was the integrity of the jury members and their instinctive and fundamental belief in the need for the trial process to be fair.
