Where a defendant was charged under s.15 Theft Act 1968, the amount of benefit that was obtained for the purposes of a confiscation order under s.71 Criminal Justice Act 1988 was the amount pleaded to in the indictment and the fact the defendant split that money with a co-conspirator was irrelevant.
