[2010] EWCA Crim 1858

The court declined to exercise its power, under the Criminal Appeal Act 1968 s.23, to receive fresh evidence consisting of affidavits sworn by a witness saying he gave false evidence at trial and had been promised assistance in obtaining leave to remain in the United Kingdom in return for giving evidence for the prosecution. The witness had not been called and the court was unable to hear why he had made contradictory statements.
