[2011] EWCA Crim 420

A confiscation order was quashed, the judge having made it in reliance on the wrongly decided case of R. v Rowbotham (John Thomas) [2006] EWCA Crim 747, [2006] 2 Cr. App. R. (S.) 99 and on the basis of the Excise Goods (Holding, Movement, Warehousing and REDS) Regulations 1992 rather than the Tobacco Products Regulations 2001.
