A decision by a judge not to specifically direct a jury regarding adverse inferences under the Criminal Justice and Public Order Act 1994 s.34 had not been prejudicial to a defendant. The judge was entitled to take the view that referring to adverse inferences might be more prejudicial than not doing so.
