[2001] EWCA Crim 1750

Common interest privilege applied to documents passing between persons who had a common interest in advancing proceedings brought or contemplated against another, or in defending proceedings brought or contemplated by another. There was no room for common interest privilege in litigation where there had been opposing parties with no common interest until settlement.
