Where fundamental human rights were in play, the courts of this country would not abstain from reviewing the legitimacy of the actions of a foreign sovereign state. The Secretary of State for Foreign and Commonwealth Affairs should give due consideration to a request for assistance from a British citizen detained abroad, but could not reasonably be expected to do more than that in the case of a British citizen detained by the US Government at Guantanamo Bay.
