The court provided general guidance based on the Hammond and Penrose report on the factors to be taken into consideration in passing sentences for a cartel offence under the Enterprise Act 2002 s.188. Prison sentences imposed on the appellants for offences under s.188 were reduced to reflect the sentences agreed under the terms of a plea bargain agreement between the appellants and the relevant authorities in the United States.
