In two trials for offences arising out of a serious incident of pubic disorder occurring at the time of the widespread riots in England in August 2011, the judge had been right to admit bad character evidence in the form of videos which suggested that certain of the defendants were involved with gangs. In assessing whether the admission of such evidence would have an adverse effect on the fairness of the trial, fairness to the prosecution, as well as to the defence, had to be considered.
