When giving a direction pursuant to s.34 Criminal Justice and Public Order Act 1994, a failure to direct the jury that an inference drawn under s.34 could not of itself prove guilt and a failure to direct as to reasonable expectations of what a defendant should have mentioned in interview, was a material irregularity in a trial and lead to convictions being quashed.
