A sentence of imprisonment for public protection had not been appropriate for one of two offenders who had pleaded guilty to charges of conspiracy to rob even though he had continued in the conspiracy after his co-conspirator had used gratuitous violence on a victim. As he had no previous convictions for violence, a determinate sentence of 11 years' imprisonment was more suitable.
