There was nothing in the Police and Criminal Evidence Act 1984 that required the police to delay taking specimens of breath in order to allow a juvenile detainee to require the attendance of an appropriate adult and magistrates had therefore been wrong to exclude a breath specimen under s.78 of the 1984 Act.
