A district judge had been correct in rejecting an application to remit an assault case for a rehearing under the Magistrates' Courts Act 1980 s.142(2). The purpose of s.142(2) was to enable the court to correct mistakes in limited circumstances; it was not a power equivalent to a full appeal to the Crown Court or High Court, nor was it a power of general review.
