A failure of the Secretary of State for Justice to provide psychiatric and psychological reports which had been requested by the Parole Board resulted in a breach of a prisoner's rights under the European Convention on Human Rights 1950 art.5(4) because the Parole Board was unable to assess whether it was necessary to confine the prisoner for the protection of the public.
