The claimant offender was entitled to a declaration that his rights under the European Convention on Human Rights 1950 art.5(4) had been infringed by a four-month delay by the Parole Board in holding his post-tariff review, but his claim for damages was dismissed as there were too many imponderables to enable a conclusion that that delay caused a delay in his eventual release.
