Where the Secretary of State for the Home Department decided, pursuant to the Criminal Justice Act 2003 s.255, to recall a prisoner who had been released early on licence the European Convention on Human Rights 1950 art.5(4) did not require the secretary of state to provide that prisoner with a review by the Parole Board of his recall decision.
