[2006] EWHC 2976 (Admin)

For the recall of a prisoner released on licence to be lawful, there had to be a justification at the time of the recall of which the secretary of state had actual or constructive knowledge, and a Parole Board on review of a recall had to be satisfied that there was a proper basis for the prisoner remaining in custody.
