It had been lawful for the Parole Board, when deciding whether to release a prisoner on licence, to take into account material provided by the Justice Secretary containing factual allegations about his pre-trial conduct, which formed part of the original prosecution case against him, but for which he had never been convicted. The court considered the meaning of the phrase "dealing with cases" in the context of the Criminal Justice Act 2003 s.239(3).
