The meaning of the Criminal Defence Service (General) (No. 2) Regulations 2001 reg.12 within its statutory context was that a representation order in the magistrates' court could only be extended to cover the instruction of a court advocate where the case involved proceedings in the case of an indictable offence in the strict sense or extradition proceedings; reg.12 did not therefore extend to confiscation enforcement proceedings in the magistrates' court.
