R (on the application of E) v SECRETARY OF STATE FOR THE HOME DEPARTMENT (2007)

PUBLISHED June 21, 2007

[2007] EWHC 1731 (Admin)

In an appropriate case the Administrative Court had jurisdiction to intervene in an ongoing criminal trial in order to ensure a defendant's right to a fair trial. However, the trial judge had primary responsibility for the conduct of the trial and its fairness, and intervention by the Administrative Court was appropriate only in exceptional circumstances.
