The commencement and service of civil proceedings were capable of amounting to harassment since they were a form of conduct that might well cause anxiety, alarm and distress. The prevention of harassment was a legitimate social objective that was capable of justifying a restriction of a litigant's rights under the European Convention on Human Rights 1950 art.6.
