A Crown Court judge had erred in ordering the return of property to the company from which it was seized as the police had been authorised to retain it, given that there were reasonable grounds for believing it was obtained as the result of an offence and its retention was necessary to prevent it being concealed, lost, damaged, altered or destroyed.
