Although the Private Security Industry Act 2001 s.1 made no express reference to the power of the Security Industry Authority to institute or continue a prosecution, it was clear, having regard to the purpose of the Act, that it had the power to prosecute. The prosecution of offences under the Act was calculated to facilitate, or was incidental or conducive to, the carrying out of the majority of the Security Industry Authority's functions.
