The Secretary of State for the Home Department's decision, that a Botswana national, who had served in the British army, had not met the good character requirement for naturalisation under the British Nationality Act 1981 because his speeding conviction was not spent, was flawed. The decision did not properly weigh in the balance the strong countervailing evidence of the applicant's good character against the fact of his conviction.
