An anti-social behaviour order should not have been made against a repeat offender who had begged for money for cigarettes and who, on the unchallenged expert medical evidence, did not have the mental capacity to comply with the order due to his severe nicotine addiction. The court below had failed to give any reasons for rejecting the otherwise unchallenged medical evidence.
