Once the prosecution had established the formal validity of an enforcement notice (by establishing that it complied with the formal requirements of the Town and Country Planning Act 1990 and had not been quashed) it was not open to a defendant to seek to defend criminal proceedings brought in relation to a breach of that notice by mounting a collateral challenge to the validity of the notice.
