Under the Criminal Justice Act 2003 s.255A to s.255C a Parole Board only considered release of a prisoner recalled to custody if the Secretary of State for Justice declined to permit his release. In considering release the board had to apply the test of whether there was an unacceptable risk to the public in releasing the prisoner.
