Whilst in the circumstances the presumption of doli incapax had been rebutted in relation to an offence under s.20 Offences Against the Person Act 1861, on the facts contained in the case stated the magistrates had not been entitled to conclude that the prosecution had rebutted the presumption in relation to an offence under s.22(4) Firearms Act 1968.
