The meaning of "a person using the vehicle" in clause 6(1)(c)(ii) of the Motor Insurers' Bureau's Uninsured Driver's Agreement could, on the facts, include a pillion who took an active role in the use of an uninsured motorcycle leading up to an accident and the Motor Insurers' Bureau were thus exempted from any liability to the pillion passenger for the injuries she sustained.
