[2010] EWHC 1247 (QB)

The fees for a preliminary hearing in the Crown Court and for a preliminary conference at court on the same occasion fell outside the Advocates Graduated Fee Scheme in Sch.1 to the Criminal Defence Service (Funding) Order 2007 because there was no indictment in existence at the time that the work was done. However, there was no power under the Order to determine payment of the fees on an ex post facto basis.
