On a proper interpretation and application of the Litigators' Graduated Fee Scheme in the Criminal Defence Service (Funding) Order 2007 Sch.2, solicitors were not entitled to a special preparation fee for time taken to listen to audio recordings in preparation for trial because those recordings were not documentary material that had been served in electronic form for the purposes of Sch.2 Pt 3 para.15.
