[2010] EWHC 1238 (Fam)

Applying the decision in C (A Minor) (Care Proceedings: Disclosure), Re [1997] Fam. 76, the court had to strike a balance between the various competing interests when considering whether to order disclosure of evidence in care proceedings to the police. The relevant factors included the public interest in the prosecution of serious crime and the punishment of offenders, as well as human rights considerations; however, the interests of the children, although important, were not paramount in such a case.
