A district judge had been entitled to find that an individual had remained in charge of a dangerous dog despite a brief transfer of physical control by handing over its lead to another, whereupon the dog had been released and had attacked and injured a third person. Therefore the district judge had been entitled to find that individual guilty of an aggravated offence under the Dangerous Dogs Act 1991 s.3(1) and s.3(4).
