A magistrates' court had erred in not acceding to an application to adjourn a criminal trial so that a witness could be traced, where it was clear that a defendant through no fault of his own had been unable to contact or secure the attendance at trial of the witness, whose evidence went to the heart of the matter before the magistrates' court.
