It was permissible in driving cases to permit the prosecution in the magistrates' court to seek and rely upon a dock identification of the accused, and it was not a breach of the Human Rights Act 1998 and Art.6 European Convention on Human Rights to require an accused to indicate prior to trial that identification of the driver was in issue.
