The English court had no jurisdiction to entertain claims against a foreign state by claimants who alleged that they had been systematically tortured by officials of that state, since under the State Immunity Act 1978 s.1(1) the foreign state was entitled to claim immunity. Part I of the Act was not disproportionate as inconsistent with a peremptory norm of international law.
