Although an appeal against an arrest warrant issued in Bermuda had been academic on the facts, the court held in an obiter decision that there was no requirement for a magistrate considering the issue of a provisional warrant for the arrest of a fugitive under the Extradition Act 1989 s.8 to satisfy himself that the alleged conduct constituted an extradition crime within the meaning of the legislation.
