A change in legal standards subsequent to the trial and conviction of a person whose conviction had been in accordance with the law at the time of trial could not be regarded as the discovery of a new or newly discovered fact" demonstrating that a miscarriage of justice had occurred for the purposes of the Criminal Justice Act 1988 s.133.
