On appeals by way of case stated on a point of law the court should only interfere with a judge's ruling if it was Wednesbury irrational. The judge's decision to admit identification evidence despite a breach of the PACE codes of practice Code D was correct as it would not cause unfairness to the defendant in the circumstances.
