On the proper construction of the Road Traffic Offenders Act 1988 s.1, a notice of intended prosecution sent to a defendant by first class ordinary post on a date that would normally lead to it being delivered within the required 14-day time limit was not properly served where the court was satisfied that it had actually been delivered outside the time limit.
