A magistrates' court had erred in finding no case to answer in favour of a taxi driver who was licensed to operate in one district but charged with plying for hire without an appropriate licence in another. The magistrates had placed too much emphasis on the fact that the driver had had a legitimate pre-booked fare at the relevant time and location, and there was clear evidence that he had held himself out as available for hire to others, upon which a reasonable tribunal could properly convict.
