Following a second finding of unfitness to plead it was necessary for the jury to reconsider the issue of whether the accused had committed the actus reus of the offence. If a reconsideration was required, the jury should not be informed of the earlier jury finding that the accused had committed the actus reus and should not be directed to follow that finding.
